Terms of Service
These Terms of Service (“Terms”) govern your access to and use of WAPA, a WhatsApp-based AI assistant operated by Konzult Technologies (founded by Ashish KD Mathpal, India). Please read them carefully. By messaging your WAPA number or activating a pass, you agree to these Terms.
1. Acceptance of these terms
By using WAPA — including sending it any message, business card, voice note, or payment — you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the service.
2. Service description
WAPA is a private assistant that works inside WhatsApp. You send a photo of a business card and a voice note; WAPA uses AI (vision to read the card, speech-to-text to transcribe your voice note into English) to produce a clean, scored, follow-up-ready lead record. You can store these leads in your account and export them as CSV/Excel. The service is provided on an “as available” basis and may evolve over time as we add or change features.
3. Eligibility
To use WAPA you must:
- be at least 18 years of age and able to enter into a binding contract;
- use a WhatsApp account you are authorised to use; and
- use the service for lawful purposes only, in compliance with applicable law.
WAPA is intended for business and professional use and is not directed at children.
4. Your responsibilities
You are responsible for how you use WAPA and for the data you put into it. In particular, you agree that:
- Lawful basis for contact data — you confirm you have a lawful basis to capture, upload and store the personal data of the people you meet (for example, cards handed to you and consent given in a business context). You are the controller of those relationships; WAPA processes that data on your behalf.
- No messaging without consent — you will not use WAPA, or data derived from it, to message, call or email your contacts without their consent. WAPA does not send outbound messages to your contacts on its own.
- No spam or unlawful use — you will not use WAPA to send spam, harass anyone, infringe rights, or for any illegal, deceptive or harmful purpose.
- Accurate information — you will provide accurate account and payment information and keep your access secure.
- Verify before you act — you will review lead data before relying on it for outreach or decisions (see Section 8).
5. Plans & payment
WAPA is offered as time-bound passes, paid by UPI. Current pricing:
- Activation — pay over UPI and your pass activates instantly. Each pass is time-bound and expires at the end of its period, after which you can buy another to continue.
- Taxes — prices are in Indian Rupees and may be subject to applicable taxes.
- Pricing changes — we may revise pricing for future passes; any change applies only to passes purchased after the change.
Refunds
Because passes activate instantly and give immediate access to a usage-based AI service, passes are non-refundable once activated and used. If you experience a genuine technical issue that prevented you from using a pass, contact us at ashish@konzult.in and we will review your case in good faith and, where appropriate, offer a credit or remedy. Accidental duplicate payments will be refunded on verification.
6. Acceptable use & prohibited conduct
When using WAPA, you must not:
- upload content you have no right to share, or that is unlawful, defamatory, obscene or infringing;
- use the service to send unsolicited bulk messages (spam) or to harvest data for resale;
- attempt to reverse engineer, scrape, overload, disrupt or gain unauthorised access to WAPA or its infrastructure;
- resell, sublicense or share your access in a way that circumvents per-account metering;
- use WAPA to build a competing dataset or service, or to violate any third party's privacy or rights; or
- use the service in any way that breaches WhatsApp's terms or applicable law.
We may investigate suspected violations and take appropriate action, including suspension or termination.
7. Intellectual property
WAPA, including its software, design, branding and the WAPA and Konzult Technologies names and logos, is owned by Konzult Technologies and protected by applicable intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the service during an active pass, subject to these Terms. You retain ownership of your own content — the cards, voice notes and leads you provide — and you grant us only the limited rights needed to process, store and deliver that content back to you as the service.
8. Disclaimer of warranties
WAPA relies on AI models for vision and transcription, which are powerful but not perfect — output may contain errors, omissions or misreadings. Names, numbers, emails, transcripts and lead scores are produced automatically and should be verified by you before you rely on them. The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability, to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, Konzult Technologies and its founder, team and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, business, data or goodwill, arising out of or relating to your use of (or inability to use) WAPA — including reliance on AI-generated lead data. Our total aggregate liability for any claim relating to the service will not exceed the amount you paid us for the pass during which the claim arose.
10. Suspension & termination
You may stop using WAPA at any time and let your pass expire. We may suspend or terminate your access — with or without notice — if you breach these Terms, misuse the service, or where required to protect the service, other users or comply with law. On termination, your right to use WAPA ends; you may request export or deletion of your data as described in our Privacy Policy.
11. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and material changes will be communicated through the service. Your continued use of WAPA after an update means you accept the revised Terms.
12. Governing law & jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with the service or these Terms will be subject to the exclusive jurisdiction of the competent courts in India. Nothing in these Terms limits any non-waivable statutory rights you may have under applicable Indian law.
